Orange Beach City Council to recognize retiring Fire Chief at Tuesday’s meeting

Orange Beach, Ala. – (OBA) – During the Sept. 5 joint regular/work session of the Orange Beach City Council, the council will recognize retiring Fire Chief Mike Kimmerling for his service to the city.


The council will consider a resolution naming Deputy Fire Chief Jeff Smith as acting fire chief.


During the regular session, the council will also discuss:


  • Two proclamations declaring Sept. 17-23 as Constitution Week and the month of September as Gynecologic Cancer Awareness Month.
  • A $720,000 contract with Rolin Construction for the interior build out of the new Wildlife Center on Powerline Road.
  • Approval of a restaurant retail liquor license application by Lauria's 2 Inc. for Lauria's at 25637 Canal Road.
  • Reappointing Susan Boggs to the board of directors of Gulf Shores and Orange Beach Tourism.
  • An agreement with the Alabama Department of Environmental Management for the city to provide permitting, regulating, monitoring and inspection services at a cost of $37,950. ADEM will reimburse the city.
  • Amending the city’s procurement policy as related to Restore Act funds being administered by the Alabama Department of Conservation and Natural Resources for the north sewer force main sewer upgrade project.
  • Authorizing the execution of a sub-award grant agreement with the National Fish and Wildlife Foundation for the removal and recycling of large-scale marine debris caused by Hurricane Sally in the amount of $367,959.
  • Resolutions authorizing a with contract with Watermark Design Group for architectural services and a contract with Watermark Design Group to provide design, bid, and construction administration services for roof replacement at the Justice Center. This was due to damage from the April 10, 2021 hailstorm in the amount of $2 million.
  • A resolution authorizing a contract with McCollough Architecture to provide design services for an event pavilion at the Coastal Arts Center for $13,500.
  • A resolution of $3.6 million to the Orange Beach Board of Education to support city school system operations.
  • A resolution authorizing a contract with McLean Motor Sports Productions for the “Bama Coast Cruisin” event as part of the 2023 Freedom Fest on Oct. 6-7 at The Wharf.
  • A resolution authorizing the purchase of a video surveillance system at Fire Station No. 3 for $29,088 from Vision Security Technologies.
  • A resolution accepting a proposal from ThreatAdvice Technologies to improve the wireless internet network at the Sportsplex in the amount of $52,002.
  • A resolution authorizing settlement in the case of Wireman, et al., v. Orange Beach.
  • A resolution authorizing consent to judgment in a January 2003 case of Brenizer Living Trust v. Orange Beach.
  • A resolution authorizing execution of a task order with Sawgrass Consulting for preparation of a land survey and subdivision final plat of the property located north of the ICW and east of the Foley Beach Express, also known as Wharf Landing, in an amount not to exceed $9,500.
  • Amending the zoning ordinance to allow for a conditional use permit for recently purchased storage buildings on Money Bayou Drive for use by Orange Beach City Schools. The buildings are directly west of the Orange Beach Middle/High School campus to be used for a weight room and storage facilities. There will be a public hearing and a possible vote by the council on the amendment.
  • A first reading of an ordinance to ban exotic animals in the city and provide regulations for sheltering animals by staffers of recognized wildlife associations and zoos.
  • Discuss amending an ordinance to allow for attending official public meetings electronically.


During the work session, the council will discuss:


  • Changing the meeting date for the Sept. 19 meeting to Sept. 12. No reason was given for the change in the agenda.
  • A resolution amending a previous resolution on the purchase of a 2024 Freightliner M2 Pac knuckleboom truck for Public Works from Ingram Equipment Company for $227,211. The company was unable to fill the order. The council will now consider a 2025 model from the state Sourcewell purchasing cooperative at $234,926.
  • Two resolutions for contracts with Tanner Myatt for golf instruction and Brandy Reeves for tennis instruction, both with the city’s Expect Excellence program.
  • Two resolutions authorizing the purchase of a Drone for the police department from Axon Enterprise in the amount of $69,324 and six drones from Adorama Camera for $90,029.
  • Resolutions authorizing the execution of a professional services agreement with Sun Coast Builders for structural engineering and related services. A second contract for engineering services for a temporary weight room for $2,500 and a third for engineering services for batting cages for $2,500. The council will also consider amending the budget to create a project budget of $250,000 for the weight room.
  • A resolution authorizing execution of a professional services agreement with J. F. Morris Performance to direct the play “The Wizard of Oz.”
  • A resolution authorizing the execution of a use agreement for two ATVs for use by the Coastal Alabama Business Chamber for the 50th Annual National Shrimp Festival.
  • Resolutions to authorize franchises for CrozzzzCabz, Gulf Limousine and Coast Cab to do business in the city of Orange Beach.
  • A resolution authorizing a franchise for BCC Waste Solutions to remove construction and demolition debris in the city.
  • Resolution to buy lighting for the Softball Field at the Sportsplex from Musco Sports Lighting for $86,500.
  • Setting a public hearing on an ordinance change to allow a conditional use permit for McInnis Company Office and Storage to add in the first phase a 7,000-square-foot covered storage area attached to the current building, a 1,520-square-foot shed and two mini warehouses of 12,500 square feet each. In the second phase, the company is looking to build a 6,000-square-feet commercial building and three mini storage buildings with a combined square footage of 25,000. The date suggested is Oct. 3
  •  Changing the speed limit on portions of Canal Road and State Route 180.
